Dear Parents,
The state of California has revised the Educational Code related to student truancy. The California Legislature has defined truancy in very precise language. In summary, it states that a student missing more than 30 minutes of instruction without an excuse on 3 occasions during the school year must be classified as truant.
The California Education Code Section that defines a truant reads as follows:
EC Section 48260(a): Any pupil subject to compulsory full-time education or compulsory continuation education who is absent from school without a valid excuse for three full days or tardy or absent more than any 30-minute period during the school day without a valid excuse on three occasions in one school year, or any combination thereof, is a truant and shall be reported to the attendance supervisor or the superintendent of the school district.
In addition to this classification, the law states that the school district must notify the parent or guardian of this student of these absences in writing by first class mail. This notification must also include specific information related to the student's unexcused absences.
The law further requires that after a student has been reported as a truant three or more times in one school year, and, after a school employee has made a conscientious effort to hold at least one meeting with the parent and the student, the student is deemed a habitual truant.
When a student meets the Education Code criteria of a habitual truant, or is significantly irregular in school attendance, the student may be referred to the school attendance review board (SARB). SARB is a panel of school and community members who meet regularly with students and their families to resolve persistent student attendance problems.
Excessive excused absences may also trigger an intervention by school personnel. Ten or more excused absences or tardies of less than 30 minutes in a single school year would be considered excessive. According to State law, only absences for illness, doctor/dentist appointments, bereavement, religious observance, and court hearings are considered excused absences. Students who have 10 or more excused absences or tardies in a single school year may also be referred to the School Attendance Review Board (SARB).
In an effort to comply with the California Education Code, SMMUSD parents will receive an attendance letter from their school principal if a student has 3 unexcused absences or 10 excused absences.
Most Santa Monica-Malibu Unified School District students have excellent attendance. Our attendance rate is approximately 95% at most school sites, but, it is critical that we continue to work to improve the attendance of all SMMUSD students. Absent students miss valuable learning experiences that help them master academic material. Consistent attendance also allows students to develop strong relationships with their peers and school staff. Students simply cannot benefit from their education if they are not in school.

El estado de California ha revisado el Código de Educación relacionado con el absentismo escolar del estudiante. La Legislatura de California ha definido absentismo escolar en un lenguaje muy preciso. En resumen, se establece que un alumno que falta más de 30 minutos de instrucción, sin una justificación en 3 ocasiones durante el año escolar debe ser clasificado(a) como ausente sin excusa.
La Sección del Código de Educación de California que define a un ausente se lee como sigue:
CE Sección 48260(a): Cualquier estudiante sujeto a educación obligatoria de tiempo completo o educación obligatoria de continuación que está ausente de la escuela sin una excusa válida por tres días completos o llegadas tarde o ausente más de cualquier período de 30 minutos durante el día escolar sin una excusa válida en tres ocasiones en un año escolar, o cualquier combinación de estos, es un ausente sin justificación y debe ser reportado al supervisor de asistencia o al superintendente del distrito escolar.
Además de esta clasificación, la ley establece que el distrito escolar debe notificar al padre o tutor de este estudiante de estas ausencias por escrito por correo de primera clase. Esta notificación también debe incluir información específica relacionada con las ausencias injustificadas del alumno.
La ley exige además que, después de que un estudiante ha sido reportado como ausente tres veces o más en un año escolar, y, después de que un empleado de la escuela ha hecho un esfuerzo consciente para tener por lo menos una reunión con los padres y el estudiante, el estudiante es considerado un ausente habitual.
Cuando un estudiante reúne los criterios del Código de Educación de un ausente habitual, o es significativamente irregular en la asistencia escolar, el estudiante puede ser referido al Consejo de Revisión de Asistencia Escolar (en inglés las siglas SARB). SARB es un panel de miembros de la escuela y la comunidad que se reúnen regularmente con los estudiantes y sus familias para resolver los persistentes problemas de asistencia de los estudiantes.
Las ausencias excesivas justificadas también puede desencadenar una intervención del personal de la escuela. Diez o más ausencias o tardanzas justificadas de menos de 30 minutos en un solo año escolar se considerarán excesivas. De acuerdo con la ley Estatal, sólo ausencias por enfermedad, citas con el médico /dentista, duelo, observancia religiosa, y las audiencias de corte se consideran ausencias justificadas. Los estudiantes que tienen 10 o más ausencias o tardanzas en un solo año escolar también se pueden referir al Consejo de Revisión de Asistencia Escolar (SARB).
En un esfuerzo por cumplir con el Código de Educación de California, los padres SMMUSD recibirán una carta de la asistencia de su director de la escuela si un estudiante tiene tres ausencias injustificadas o 10 ausencias justificadas.
La mayoría de los estudiantes del Distrito Escolar Unificado Santa Monica-Malibu tienen una excelente asistencia. Nuestra tasa de asistencia es de aproximadamente 95% en la mayoría de los locales escolares, pero, es fundamental que sigamos trabajando para mejorar la asistencia de todos los estudiantes de SMMUSD. Los estudiantes ausentes pierden valiosas experiencias de aprendizaje que les ayudan a dominar el material académico. La asistencia consistente también permite a los estudiantes desarrollar fuertes relaciones con sus compañeros y personal de la escuela. Los estudiantes simplemente no pueden beneficiarse de su educación si no están en la escuela.
